Responsibility assessment

Disputing ICBC’s Crash Responsibility Assessment

Enhanced Accident Benefits are generally available regardless of who was responsible, but ICBC's responsibility assessment can still affect insurance consequences and vehicle-damage issues.

If You Disagree

ICBC publishes a specific responsibility-assessment dispute process. Review the assessment, gather the evidence that supports your version and follow the formal review steps.

Photos & video

Scene, vehicle damage and dashcam evidence can help establish what happened.

Witness information

Independent witnesses may matter where accounts conflict.

Road rules

Signals, lanes, right-of-way and other traffic rules can affect the assessment.

Written reasons

Understand the basis for ICBC's percentage decision before challenging it.

CRT Deadline Warning

ICBC currently states that after receiving the formal CL722 responsibility decision following the internal review process, a person has 90 days to file the responsibility dispute with the Civil Resolution Tribunal. Verify the current rule on the date of your dispute.

Evidence

Reconstruct the Collision, Not Just the Argument

A stronger responsibility challenge connects the evidence to the road layout, vehicle movements and rules that ICBC used in the assessment.

Sequence

Write a clear timeline of lane position, signals, turns, braking and impact rather than relying on a general statement that the other driver was at fault.

Independent evidence

Dashcam footage, witnesses, photographs and objective scene information can be more useful than competing recollections.

Decision reasons

Compare the evidence directly with ICBC's written reasoning and percentage assessment.
